1. Acceptance of Terms

AIInterviewer is operated by AIInterviewer Inc. ("we", "us", or "our"), a company incorporated under the laws of the United States with its registered address at 123 Innovation Drive, Suite 400, San Francisco, CA 94107. By accessing or using AIInterviewer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AIInterviewer provides an AI-powered recruitment platform that automates candidate screening, interviews, and evaluation. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

3. User Responsibilities

You agree to:

  • Maintain the confidentiality of your account credentials
  • Use the Service in compliance with all applicable laws and regulations
  • Not use the Service for any illegal, fraudulent, or unauthorized purpose
  • Not interfere with or disrupt the integrity or performance of the Service
  • Not attempt to gain unauthorized access to any part of the Service
  • Be responsible for all activities that occur under your account

4. Payment Terms

All payments are processed by our payment service providers, Waffo Pancake and Creem, each acting as Merchant of Record (MoR) for the payments it processes. The provider used depends on the payment option presented to you at checkout. AIInterviewer offers credit pack purchases — one-time purchases of AI interview credits that are added to your account balance upon successful payment. Credits expire 30 days after purchase. By purchasing a credit pack, you agree to:

  • Pay the full price for the chosen credit pack at the time of purchase
  • Provide accurate billing and payment information
  • Credits are consumed as you use AI interview features; unused credits expire after 30 days
  • All fees are exclusive of applicable taxes unless stated otherwise

5. Credit Packs and Cancellation

AIInterviewer does not offer automatic recurring billing. Each credit pack is a one-time purchase — you pay once and the credits are added to your account immediately. Credits do not renew automatically.

You may cancel your account or request a refund as described below at any time. Upon cancellation, your remaining credits remain available for use until they expire or your account is deleted, whichever comes first.

Refund Policy:

  • Within 14 days of first purchase (Annual credit packs): Full refund available.
  • Within 48 hours of any charge (Monthly credit packs): Full refund for that purchase.
  • After the above windows: No refunds for unused credits, but you may continue using them until they expire.
  • Duplicate Charges: Full refund for duplicate charges caused by billing errors.
  • Verified Service Outage: Pro-rated refund or credit for outages exceeding 72 hours.
  • Legal Rights: Refund rights under applicable law (e.g., EU/UK 14-day cooling-off period) are preserved.

Your data is retained for 90 days before permanent deletion after account deletion or cancellation.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. AIINTERVIEWER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

6.1 AI Output and Intellectual Property

Output Ownership: AI-generated content produced by the Service ("Output") belongs to you, provided you comply with these Terms and the Acceptable Use Policy.

Input License: By submitting content to the Service ("Input"), you grant AIInterviewer a limited, non-exclusive license to use the Input solely to provide the Service to you. We will not use your Input to train AI models without your explicit consent.

Third-Party AI Dependency: The Service uses the DeepSeek large language model (deepseek-chat) provided by DeepSeek. Output quality may be influenced by this third-party model. We do not guarantee specific Output quality and are not responsible for content generated by third-party AI models.

⚠️ AI Output Disclaimer: AI-generated content may contain inaccuracies, incomplete information, or outdated content. Do not use it for legal, medical, financial, or other professional advice. Always verify AI content with qualified professionals before taking action.

7. Acceptable Use

You agree not to use the Service to:

  • Conduct any illegal activity or violate any person's rights
  • Generate spam, malicious content, or harmful code
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Use automated systems to access the Service without permission
  • Harass, abuse, or harm other users
  • Use AI outputs to train competing AI or ML models
  • Mass scrape or collect model outputs beyond personal authorized use
  • Present AI-generated content as human-produced professional advice (e.g., legal, medical, financial)

8. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after any changes constitutes acceptance of the modified Terms.
